TERMS OF SERVICE – URCROWN (URKINGDOM LLC)

1. Introduction and Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the UrCrown website located at www.urcrown.com (the “Site”) and all products and services offered by URKINGDOM LLC, operating under the brand UrCrown.

By:

  • Accessing or using the Site

  • Creating an account

  • Making a purchase

you acknowledge that you have read, understood, and agree to be legally bound by these Terms.
If you do not agree, you must discontinue use of the Site immediately.

Age Requirement

You must be at least 18 years of age, or the legal age of majority in your jurisdiction, to make a purchase on this Site.
The Site is not intended for children under the age of 13, and UrCrown does not knowingly collect personal information from minors.

2. Important Medical Notice and Limitations

NOT A MEDICAL PROVIDER

UrCrown and URKINGDOM LLC:

  • Are not medical or healthcare providers

  • Do not diagnose eye conditions

  • Do not replace the advice of a licensed eye care professional

All decisions regarding vision correction should be made with a qualified ophthalmologist, optometrist, or licensed eye care professional.

Prescription Validity

You agree that:

  • Prescriptions used to order eyewear must be valid and current (typically issued within the last two (2) years or as required by applicable law)

  • Outdated or incorrect prescriptions may result in incorrect products, for which UrCrown is not responsible

UrCrown strongly recommends regular eye examinations.

Limitation of Responsibility

UrCrown is not responsible for harm, discomfort, or incorrect products resulting from:

  • Outdated prescriptions

  • Inaccurate information provided by the customer

  • Failure to obtain proper eye examinations or follow-up care

Assumption of Risk

By purchasing and using UrCrown products, you acknowledge and accept the inherent risks associated with vision correction products, including but not limited to adaptation periods, visual discomfort, or dissatisfaction due to individual sensitivity or expectations.

3. Prescriptions and Verification

All prescription eyewear, including prescription eyeglasses and contact lenses, must be ordered using a valid prescription issued by a licensed eye care professional.

To comply with applicable U.S. laws and regulations, including the Fairness to Contact Lens Consumers Act (when applicable), UrCrown may:

  • Request a copy of your valid prescription

  • Request additional prescription details (e.g., PD, sphere, cylinder, prism)

  • Contact your licensed eye care provider, optometrist, ophthalmologist, clinic, or medical office to verify the authenticity and accuracy of your prescription

  • Obtain prescription confirmation directly from your provider when authorized by you

By placing an order for prescription products, you acknowledge and agree that:

  • You have read, understood, and accepted these Terms of Use;

  • You authorize UrCrown and URKINGDOM LLC to contact your eye care provider for the purpose of verifying or obtaining your prescription information when necessary to fulfill your order;

  • You grant permission for your provider to release prescription details to UrCrown for order fulfillment purposes, where permitted by applicable law;

  • You consent to being contacted by UrCrown for order-related purposes, including prescription verification, missing information, clarification requests, payment issues, shipping matters, or any other matter necessary to complete your order.

Such contact may occur through any communication method you provide to us, including but not limited to:

  • Email

  • Telephone calls

  • SMS or text messages

  • Customer service messaging systems

  • Social media direct messages

  • Or other reasonable communication channels associated with your account or order

This contact authorization applies strictly to transactional and order-related communications and does not constitute consent to receive marketing communications unless separately agreed to.

You are solely responsible for the accuracy, completeness, and validity of the prescription information provided. UrCrown shall not be responsible for errors, discomfort, or incorrect products resulting from inaccurate, incomplete, or outdated prescriptions.

If a valid prescription cannot be verified within a reasonable period of time, UrCrown reserves the right to delay, suspend, or cancel the order until proper verification is completed.

Telemedicine / Remote Eye Care

UrCrown does not currently provide telemedicine or remote optometry services. Any such services, if offered in the future, will be provided exclusively by licensed professionals under separate agreements and informed consent documentation.

4. Products and Intended Use

UrCrown offers:

  • Prescription eyeglasses

  • Contact lenses

  • Sunglasses

  • Optical lenses and treatments

  • Accessories

Products are intended for personal use only, including vision correction and sun protection.
Failure to follow care or usage instructions may reduce performance or void warranties.

5. Ordering, Payments, and Pricing

Ordering Requirements

Orders may require:

  • Prescription information

  • Pupillary distance (PD)

  • Measurement details

Payments

Payments are processed securely through Shopify Payments, PayPal, and other payment methods made available through the Shopify platform.
UrCrown does not store full payment card details.

Pricing and Taxes

  • Prices may change without notice

  • Applicable taxes are calculated at checkout

  • The final price is displayed before order confirmation

6. Shipping and Delivery

Processing Times (Estimated)

  • Non-prescription products: 13–15 business days

  • Prescription optical products: 13–15 business days depending on customization

Shipping Area

Currently shipping within the United States.

Lost or Damaged Packages

Customers must notify UrCrown within 5 business days of delivery if an order is lost or damaged.
UrCrown will assist with claims or resolutions in accordance with carrier policies.

7. Returns, Refunds, and Warranty

Warranty

Frames may include a limited one (1) year manufacturer warranty covering manufacturing defects only.

15-Day Return Policy

Eligible products may be returned within 15 days of receipt, subject to inspection and approval.
Products must be unused and returned in original packaging.

Non-Returnable Items

  • Contact lenses

  • Customized prescription lenses, unless manufactured incorrectly

No Guarantee of Subjective Satisfaction

UrCrown does not guarantee subjective satisfaction, personal preference outcomes, or visual comfort, as these may vary based on individual perception, prescription accuracy, and usage conditions.

UrCrown is not responsible for errors caused by customer-provided prescription information.

8. Intellectual Property

All Site content, including branding, designs, images, and text, is the exclusive property of URKINGDOM LLC.
Unauthorized use, reproduction, or distribution is prohibited.

9. Limitation of Liability

To the fullest extent permitted by law, UrCrown is not liable for indirect, incidental, or consequential damages.
UrCrown’s total liability shall not exceed the amount paid for the product at issue.

Force Majeure

UrCrown is not responsible for delays caused by events beyond reasonable control.

Time Limitation on Claims

Any claim related to a purchase or use of the Site must be reported within fourteen (14) days of product delivery. Claims submitted after this period may be barred.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Any legal action must be filed exclusively in the state or federal courts located in Sacramento County, California.

Dispute Resolution and Notice Requirement

Before initiating any legal claim, you agree to notify UrCrown in writing and allow a reasonable opportunity to resolve the issue through good-faith communication.

If a dispute cannot be resolved informally, the parties agree to attempt mediation or arbitration under mutually agreed terms before pursuing formal litigation.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You expressly waive any right to participate in a class action lawsuit against UrCrown or URKINGDOM LLC.

11. Changes to These Terms

UrCrown may update these Terms at any time. Updates are effective upon posting. Continued use of the Site constitutes acceptance of revised Terms.
